Christmas behind bars: Cafe owner 'in shock' over prison sentence

A Kaik艒ura cafe owner jailed for two months for selling food without adequate council registration is languishing in the local police cells awaiting a transfer to prison - where the first-time offender will spend Christmas without her family.

Her family say she is still in shock, upset and tearful over the sentence which they have described as 鈥渃razy鈥 and 鈥渁n absolute waste of taxpayer dollars鈥.

The two charges, under the Food Act 2014, were brought by the Kaik艒ura District Council.

The maximum penalty for the charges is two years imprisonment and a $100,000 fine.

Kaik艒ura District Council CEO Will Doughty said it was 鈥渞egrettable鈥 that the council had 鈥渘o other option but to prosecute鈥 Rayner.

聽鈥淭he Court鈥檚 ruling is sadly the inevitable conclusion of a year-long process in which Ms Rayner has been provided with numerous opportunities by Kaik艒ura District Council to comply with the Food Act, as all other food sellers do, and avoid prosecution 鈥 opportunities which she chose not to take,鈥 he said in a statement posted to Facebook on Sunday.

Doughty said Rayner had 鈥減reviously complied with food safety regulations鈥.

However, in 2021 she requested that her valid food registration be withdrawn.

鈥淪he then continued to sell food to the public without food registration measures in place at her cafe Bean Me Up, and has continued to do so right until the day of sentencing,鈥 said Doughty.

鈥淔or Kaik艒ura District Council not to seek prosecution of a food operator who has been given every opportunity to comply with the Food Act by Council and the Court would have been a dereliction of Council鈥檚 duties to the public under the safety provisions of the Food Act.

聽鈥淚t would also have been unfair to other businesses who meet their food safety requirements under the Food Act 鈥 indeed many in the same street.鈥

Rayner and her family acknowledge she did not legally comply with the Food Act but maintain that both her business and the produce served complied with the rules.

She simply did not want to register anything with the council.

Rayner鈥檚 daughter Holly Timms told the Herald her mother was still being held in the police cells at Blenheim, waiting to be transferred to Christchurch Women鈥檚 Prison.

She had been able to spend time with her there and has also spoken to her on the phone.

鈥淪he鈥檚 doing okay given the circumstances, but she鈥檚 in shock, she鈥檚 in disbelief,鈥 Timms said.

鈥淪he wasn鈥檛 prepared for jail, we thought maybe she would get home detention but that was never discussed.鈥

Timms said her mother was distrusting of authorities and refused a court-appointed lawyer and government-funded Legal Aid.

鈥淭his is her first offence, she鈥檚 never even had a speeding ticket - she鈥檚 55 years old and the first port of call was to send her to prison?鈥 Timms said.

鈥淲hat the hell has just happened?

鈥淎t the moment she鈥檚 just going through the motions, she鈥檚 a bit upset, she鈥檚 been crying... her dog misses her, my grandma is beside herself and told me 鈥業鈥檓 going to die from this鈥.鈥

Timms said for her and the wider family it had been a 鈥渧ery emotionally draining time鈥.

While there was a lot of support for Rayner in her community and across New Zealand, there was also a lot of hate being directed at the family.

鈥淚鈥檝e had random idiots message me on Facebook and say 鈥業 hope your mum dies in there鈥 and 鈥業鈥檓 glad she got jail time, she鈥檚 a piece of sh*t鈥,鈥 Timms said.

鈥淚t鈥檚 just crazy.鈥

Timms accepted there had to be a consequence in her mother鈥檚 case but said prison was 鈥渞idiculous鈥.

鈥淚 look at the case of Jayden Meyer in Tauranga and he didn鈥檛 even get any jail time for rape,鈥 she said.

鈥淚t鈥檚 pretty shocking... it鈥檚 a complete overreach.鈥

Earlier this year Meyer was聽聽for the rape of four 15-year-old girls and the sexual violation of another.

He was 16 at the time of the offending.

鈥淪o why are they doing this to mum? There鈥檚 just no empathy, no compassion,鈥 Timms said.

Timms hoped that she would be able to spend time with her mother at the prison on Christmas Day.

But the holiday season had been ruined by the sentence.

鈥淚 don鈥檛 even want to put the Christmas tree up, it doesn鈥檛 feel very festive or worth celebrating,鈥 she said.

She said her mother still did not want a lawyer so it appeared she would serve the time and then return to Kaikoura to try and restart her life.

鈥淎t the moment she hasn鈥檛 thought about what she鈥檚 going to do, there鈥檚 no master plan yet - it鈥檚 really just taking each day as it comes and riding out the sentence,鈥 Timms said.

鈥淚t鈥檚 just unbelievable - she鈥檚 done no harm to anyone, there has never been a complaint to the council about her, there鈥檚 been not one case of sickness related to her cafe since she started it in 2012, she鈥檚 been in hospo for 40-plus years and they鈥檝e just thrown her in jail?

鈥淚t鈥檚 just awful.鈥
