'A f* ugly mess': Gang boss' text after fatal hotbox attack on mate of 20 years

The president of the Tribesmen Aotearoa gang says he didn鈥檛 want a fellow member to be killed, and didn鈥檛 order a 鈥渉otbox鈥 attack to take place. 

Mark 鈥楽hark鈥 Hohua died after a series of assaults at president Conway Rapana鈥檚 Hodges Rd property in Waimana, Eastern Bay of Plenty in June 2022. 

The Crown has told a jury that the attack was a hotbox, ordered by Rapana, who was allegedly upset that the 48-year-old victim had set up an automatic payment from the gang鈥檚 bank account for three online purchases. 

A hotbox is when a gang delivers a beating to one of its members. 

In his closing, Crown Solicitor Richard Jenson said Rapana had been heard to say that Hohua 鈥渘eeded to be killed鈥 after finding out about the money. 

Rapana, vice-president Heremaia Gage, patched members Ngahere Tapara and Te Patukino Biddle, and prospect Dean Collier are on trial in the High Court at Hamilton, accused of Hohua鈥檚 murder.

鈥楬e didn鈥檛 want him to die鈥 

Rapana鈥檚 defence counsel Nick Dutch said Hohua鈥檚 death was a 鈥渢ragedy, we can鈥檛 shy away from that鈥. 

鈥淥n 19 June 2022, Conrad Rapana lost his friend of over 20 years.鈥 

Rapana had previously taken Hohua to his house to help shake him out of his addictions, banning drinking and drugs, and instead getting him fit and strong. 

Hohua鈥檚 partner, Rebecca Van Der Aa, testified that she 鈥渉ated鈥 Rapana but she admitted the pair had been friends and that Rapana had tried to help Hohua, including when he鈥檇 threatened her. 

Dutch also reminded the jury about a time when Hohua texted his resignation to the gang in the weeks before his death. 

鈥淐onrad鈥檚 response was, 鈥楲ove you brother, I will miss you, my bro, Tribesmen鈥. 

鈥淯nfortunately, though, Mark Hohua died. 

鈥淣o one wanted this to happen. Conrad Rapana certainly didn鈥檛 want him to die.鈥 

He disagreed with the Crown鈥檚 suggestion that Hohua鈥檚 death was planned. 

鈥淭his was instead unplanned fighting. 

鈥淚t was just chaos.鈥

There was also no hotbox, he said. 

鈥淚t wasn鈥檛 a hotbox. The children wouldn鈥檛 have been there if there was a hotbox. 

鈥淸Rapana鈥檚 partner] wouldn鈥檛 have been there if it was a hotbox.鈥 

In a text exchange with Gage, Rapana had described the incident as 鈥渁 f ugly mess鈥. 

鈥淎nd that鈥檚 what it was,鈥 Dutch said. 

There was also no evidence that Rapana had ordered a hot box on Hohua. 

鈥淭here鈥檚 no evidential foundation. 

鈥淭he text evidence is that no one knew.鈥 

It was the opposite, in that Rapana hadn鈥檛 been heard saying to start a fight, only to 鈥渟top鈥 fighting. 

鈥淭hey just heard him say, 鈥榮top鈥 with urgency.鈥 

Biddle鈥檚 lawyer, Matthew Goodwin, told the jury earlier in the trial that Hohua鈥檚 fatal injuries were caused when he fell on a set of steep and unstable concrete steps while fleeing the house. 

Dutch reminded the jury that Justice David Johnstone had already made it clear that they can鈥檛 convict the defendants of murder if they鈥檙e not sure he did fall. 

鈥淎nd you can鈥檛 guess, because if there are two or more logical conclusions, you can鈥檛 draw an inference that one is preferred to the other.鈥 

He referred to a pathologist鈥檚 evidence, who ruled that the head injury being caused by a fall was 鈥渁n entirely possible scenario鈥. 

鈥淢r Rapana is not guilty of murder and not guilty of manslaughter.鈥 

鈥楬e鈥檚 admitted culpable homicide鈥

Biddle鈥檚 counsel, Matthew Goodwin, said his client鈥檚 phone call from June 28, 2022, held several key markers of his client鈥檚 defence. 

He admitted giving Hohua 鈥渁 hiding, or at least part of it鈥. 

鈥淗e knew he鈥檇 made some sort of contribution to his death because he talks about manslaughter. 

鈥淥f course he鈥檚 had no legal advice for that call ... but he was pretty much on the money because he pleaded guilty to manslaughter.鈥 

In the phone call, played again to the jury, Biddle is asked by a friend about what happened and whether he was 鈥済oing down for it, and did you give him the hiding?鈥 

鈥淧retty much,鈥 Biddle replied. 

Asked whether his defence couldn鈥檛 be that someone had 鈥渟ent him鈥 to do it, he replied, 鈥渘ah, nope鈥. 

He then said his 鈥渋ntention was never to kill him鈥. 

鈥淭he c**t just jumped off the bank and f himself up,鈥 Biddle is heard saying. 

Goodwin also took issue with Jenson, on behalf of the Crown, appearing to only take pieces of his client鈥檚 evidence that suited them. 

鈥淭he staircase was a crucial factor ... in causing Mr Hohua鈥檚 injury. 

鈥淭he Crown is scared of that reality, and that鈥檚 why they try to present a different picture to you.鈥 

Jenson had submitted that Biddle was trying to 鈥渟often the blow鈥 by admitting manslaughter on the phone. 

鈥淩eally,鈥 Goodwin asked. 

鈥淚 gave him a hiding and I鈥檓 guilty of manslaughter. 

鈥淚鈥檓 not sure that鈥檚 what I would call softening the blow to a friend. 

鈥淗e鈥檚 admitting culpable homicide, which is manslaughter.鈥 

Goodwin said all he asked of the jury was to 鈥渁pply fairness and common sense鈥. 

鈥淚sn鈥檛 the Crown really cherry picking the evidence that suits them, then rubbishing the evidence that doesn鈥檛?鈥 

He said Biddle鈥檚 admission was a 鈥渕ajor road block鈥 for the Crown鈥檚 aim to get murder convictions. 

鈥淭he just verdict for my client is not guilty to murder,鈥 he said.
